Here's where the rubber meets the road. Figuratively, we can agree a Twinkie is likely to have a longer shelf life than a cup tack. Is setting a cup tack as a monument negligence? Negligence is defined as a failure to meet the standard of care.

Anyone willing to lay odds or take bets on what BPELSG staff would do with a complaint for the same?

I use these as well. Out here I do not worry about countersinking but you can buy their bit and countersink those in areas where people are concerned about them being bladed out

Or concerned about it being a tripping hazard in a sidewalk.

BTW, a deceased surveyor in Oakland, a friend of mine, used to set his random traverse points at very conspicuous locations in sidewalks near intersections. He'd countersink a nail & washer down 3/8" or so from the concrete surface. What was COOL was that the washers had his name & telephone number, then he filled the hole with epoxy so they were like little business cards. Anyone looking for a surveyor would see them and call.

Regarding durable nails, we have been using bronze ring shank nails, sourced from boat building suppliers, for most all cases where tags are being set. Seem to be holding up well over time. Took a while to find these after one of our local surveying suppliers stopped carrying a similar item.
