Hi,

This case was recently decided in Vermont. I thought the librarians out there (like me) would find it interesting. I tracked down the surveyor and he was kind enough to send me the related plat maps.

Interesting case. Interesting to me because of the way things change the more you think about them. Like the judge I was inclined right off the bat to go with the 300' along the road. But my initial inclination was to try, somehow, to get right angles into the final 3 corners. Then, reading further, it became obvious that the second surveyor and the judge were correct in concluding that what was really meant was, "then turning to the right" and not "at right angle."

Lessons learned: a) don't always commit to your first impressions; b) there are legions of lousy deed scriveners out there from past centuries; c) regularly force yourself to re-read the tried and true basics of the profession.

In communicating with the prevailing suveyor, his response was "Evidence Prevails."

Do you have a better link, I can not seem to open this one.

Be aware that Vermont rules are somewhat different than California. Never the less it is interesting.
