Maybe this conference would be the excellent forum to discuss the "bogus theory"!!!

Or at least have a presenter explain it?

The plot: An aliquot corner exists within a section. Better yet, several established aliquot corners exist - a whole peaceful community of monumented corners. Folks in the community know them and have been at peace with them for years.

Then one day, an alien with superior technology arrives in the community and determines that the corner monuments everyone has known and been happy with are technologically deficient. The alien then seeks to replace the real corners with technologically superior doppleganger corners.

Choas in the community ensues. How will Mulder & Scully solve this one?!

That is great! We should all join forces and write a story about that. My brother is a writer and he gets involved in a lot of these ideas. One person writes the first chapter and the story is passed on. If I can find time I would start that and we can pass the thing along. Could be fun!

The discussion is really about the Manual procedures on subdividing a PLSS section with existing established boundary lines........as opposed to the Bouman-Robillard "bogus theory" of ONLY using the protracted original section center lines as stated in Clarks latest "book"!

Why not bring it up at your convention????

From Vaughan v. Knowlton, 112 Cal. 151 (1896):

"There being no evidence tending to show that any different line had ever been run upon the ground than the one indicated by the old stakes found at "B" and "C," and that line being approximately in the center of the section, it should be taken, in the absence of all other evidence, as the half-section line."

And

"It is true there was no direct evidence that the line contended for by plaintiff was an authorized survey, but the fact of its close correspondence to the actual center line of the section, and the presumption, in the absence of evidence to the contrary, that the line, if run, was so run as to divide the section in two equal parts, is sufficient to require a reversal of the judgment. We come to this conclusion with the less hesitation because the question of boundaries of land is important, and should be fairly and finally settled and fixed, to the end that further disputes and litigation shall be avoided."

The problem is that some BLM State Offices practice the "bogus theory", while others do not! Yet, I cannot get an official opinion from the BLM headquarters on exactly what is the BLM's policy on subdividing sections in the PLSS.
