Certificate of Acknowledgment

CA Senate Bill 1050 was filed August 15, 2014, which amended Section 1189 of the State Civil Code. The effective date of this amendment is January 1, 2015.

Note: According to the California Secretary of State’s office; yes, the physical box bordering the new text is required, even on maps (above State of California, County of______). Sacramento County Clerk/Recorder confirmed this requirement. The County also noted that any Acknowledgment signed and dated prior to January 1, 2015 may use the current Acknowledgment even if the map gets filed/recorded after December 31, 2014.

If submitting a Final Map or Parcel Map to be filed/recorded in the next month or so, be sure to communicate with the owner, or others who may be signing with a notary, to coordinate the signing date so as not to have the map rejected by the Clerk/Recorder.

The article says the box is not required, just an example.

The text of the revised statute requires the statement to be enclosed within a box.
We have modified our acknowledgment for Notices to be two lines across the top of the 8 1/2 x 11 form within a box in order to save space.

I understand why.

My wife was a notary, and many people thought her signature was some sort of a guarantee of the document's authenticity, correctness, truthfulness and lawfulness.
