Hello All. Is there a time limit to record the perfecting Deeds once the LLA has been approved and recorded?

Not to my knowledge. Out of curiosity, is there any reason they would not be recorded in a timely manner?

Best to check with the city or county you are working in but, I can answer the question for both the cities of Murrieta and Lake Elsinore in Riverside County which are as follows;
Murrieta - one month following the city approval date noted on the Lot Line Adjustment.
Lake Elsinore - 30 days following the approval date noted on the Lot Line Adjustment.

I wonder if a deed is recorded 60 days later, what would that do?

That remains a mystery. The intention was to have it recorded. Two deeds were prepared; one was recorded and the other doesn't come up in research...

The City doesn't have a limit established in the Municipal Code. Would the Recorder's Office have a limit for these recordations?

The recorder's office would not have a limitation. If these cities require a limitation, than that is a condition of approval or, what we might call a "condition precedent."

City of Hayward is one year, and stated on the map.
City of Fremont is 90 days.

Personally I like the one year before being void, because commercial dealings, or sales may be delayed which is associated with the LLA for a new owner.

Furthermore I know a number of LLA's do not get recorded with all of the appropriate documents, which is due to the fact the governing agencies do not give clear directions to the public because planning takes the lead without a surveyor. I have copies of recorded documents from my clients to validate my concerns.

I commend the City of Hayward for their processing procedure as it is clear and directive on what to do. It doesn't hurt that I use to work there, but they have staff to discuss and understand the process and any boundary concerns.

in my experience the hang up on the LLA process is not the agency, but the parties involved, don't do their part in a timely manner. and then there is the banks, securing a modification of a deed of trust can take forever.

i agree there should be a time limit, but to me its not clear what would be reasonable.

The biggest delay we have is dealing with loan modifications when the loan is being serviced in Texas.

I would recommend initially 90 days and then, permit a maximum of three additional extensions for a total of one year.

This is something CLSA could easily address and promote if the organization wanted to.

Great! The response has been overwhelming. Best of all, the seminar has raised a lot of money for CLSA and a lot of people have joined the association.

If there is it is noted in the approval of the Cert of Compliance. I happened on this very thing in Riverside County's City of Corona. The action was approved but no one noticed there was a date of completion for perfection in the approval. Turned out that it hadn't been completed and the action's approval was nulified.
