So as I am working on yet another estimate, researching filed maps, looking at Google Earth to locate street monuments, it appears street monuments were not set as shown on a 2007 subdivision map within county jurisdiction (unincorporated areas). The Surveyors Statement clearly addresses the monuments will be set and occupy the positions after the monuments are inspected and adjusted to the satisfaction of the County Surveyor.
I have sent an email to the County Surveyor, so lets see where that goes?

I went through this exercise to address a similar situation a couple years ago with the County Surveyor, and requested evidence that Section 66497 of the Subdivision Map Act was satisfied for a specific 2004 map. That effort to work with the county went nowhere and I simply wasn't comfortable taking that job.

What is the appropriate action on this, when street monuments are not confirmed to be set as identified on a subdivision map? I know the surveyor of record is responsible, but if a government agency doesn't follow through with their responsibilities and approve a map, are they at fault too?

During my 9.5 years employed with the City of Hayward, we simply got a checklist item added to the final inspection, but it is evident other jurisdictions do not have that simple task identified.

Agree that it should be on the checklist prior to accepting the improvements or final occupancy of the buildings. That being said, first question you should ask the County Surveyor is if they are still holding a surety for setting these monuments. At the agency I worked for, we always required CD's to guarantee setting of monuments because they don't run the risk of expiring like a bond does. Only problem is that after so many years, the value of the CD will likely not be enough to cover setting of all the monuments. In the rare instance where setting of monuments slipped through the cracks, we then had to decide which were the most important monuments and focused on getting those set using the money from the CD.
