I wanted to thank the Orange County chapter for yesterday's presentation by Dave Woolley. it was thought provoking and an interesting topic. It is my opinion we should spend more time discussing topics like this as opposed to arguing about who measures best. What good is measuring to the nearest millimeter if the correct location is thirty feet away.

What was the presentation about?

The presentation detailed a land surveyor negligence case in which I was the expert. I discussed the work product, the lawsuit, the outcome and the BPELSG actions. The presentation was prerecorded. It will be made available to the public someday.

The Orange County Chapter recently started a YouTube channel. We have recorded 10 videos scheduled to be released every other week. The first video is "Monument Descriptions", the next scheduled releases are "Setting Durable Monuments", "Mapping Monuments". "RTK Accuracy" etc.

Lastly, if anyone has a topic they would like to see discussed or to discuss in an interview or presentation format please email me. We have a audio/visual studio for this purpose.

Agreed Boundary Doctrine - Diving into Mr. Karoly's paper...

I just got a Superior Court decision on an agreed boundary case -- it was filed on April 6. Don't know if the plaintiff is going to appeal yet, though.

What to say and how to say it and what not to say

I could use some perspective on this and examples are hard to find....

I can do something like that, time permitting. A large portion of my work is litigation based and I prepare a lot of reports. It give a new perspective to one's work, knowing there is someone out there who is going to challenge it.

Sometimes, in addition to a survey report, declarations from property owners relative to access interests can be shown on the filed record of survey.

At last year's Conference, Gary Kent had a great PowerPoint on "Being an Expert Witness" which included an excellent & thorough report(!!!) that, if I understood correctly, follows Rule 26 of Federal Rules of Civil Procedure.

Yes and the states have their own adopted variations of Rule 26.
My expert witness report style diverges somewhat from the "standard", but client's tend to like it and tell me not to change it.

I suppose there is a difference between an "expert witness report" and a "surveyor's report", but I don't know what that may be.

They are different, in a small way, but very similar. I usually prepare a surveyor's report for most of my surveys, given the nature of same. I would post some but they are not permitted.
