County Recorder Fees for RS

Solano County Recording Fee for a Record of Survey is $148. Then they add on $75 for that other fee. Is this OK? Can a Recorder just charge whatever they want to when recording a map?

There is some discretion, but generally, the Board of Supervisors adopts recording fees within an ordinance authorizing its collection. Our Recorder compiled a study, and lowered the filing fee for the first page of maps from $10 to $9, and $2 for each additional page. For records of survey, the $75 SB2 surcharge is not added, as no new parcels are being created.

When I was preparing maps in Sonoma County, we noted in the Recorder's Statement that the map was being filed at the request of the County Surveyor and had the following note immediately under the Recorder's Statement:

"EXEMPT FROM SB2 FEE PER SS 27388.1 (a)(2)(D)"

This won't help the outrageous $148 recording fee, but may help otherwise.
