Stiffed on Surveys etc

I light of that great thread about setting wood stakes and establishing boundaries, I thought I'd share a bit of Aggrevation.

Over the years of business, I have been "stiffed" for Surveys, in many ways.
Some simply cant Pay for the survey, others, get their stake with the yellow cap, and wont pay for a map, and even some have passed away.

Employing collection companies, may sometimes work, and I do that.

But meanwhile, I file the map on my own dime.

From this day forward, I want to title these as
RECORD OF SURVEY
FOR
"ME"

Now that being offered, I suppose it would be slanderous to make a note on the map stating that the client wouldnt pay.

Can anyone offer a history of why 8766 was written, and for what purpose ? And when was it intended for the local public agency to dictate your map, and also make more of a profit than the survey itself. ???

Filing a Record of survey, was to place on public record, the findings of retracement and noting of any discrepancies found.

It was a Public service by a private Surveyor and his client. NOT a taxable commodity. ?

I'd really like to know what the initial intent of 8766 was.

We've all seen Monuments named "Jackie" or some other female name. Why don't you put "Would" on one monument description on the map, then "Not", "Pay" and "Jerk" for the 4th corner. Just names, not slander!

I think it would have to be untrue to be slander though, so if they paid after the map recorded.....

I've never had a client die before paying (yet), so I'm not certain how I'd handle that. Bill the estate, I guess and go from there.

For those who don't have the $, I've worked out payment schedules. If they work with me in good faith, I have waived late fees. This has worked out a couple of times, and not worked a couple of times.

For those who won't pay, there are liens and small claims court. One client had m do a bunch of work as he was preparing for bankruptcy (which I was ignorant of). I went and wasted my time at the creditors' hearing only to have the AJ dismiss my claim while the client sat there giving me a really smug smirk. Found out at the hearing that this was the 3rd time he had declared bankruptcy. At least I had collected a deposit, so it could have been worse.

Unfortunately, there is nothing in the PLSA about waiving the checking and recording fee, so we're stuck with it. Also unfortunately, we can't go undo our surveys (pull irons already set) because the client won't pay. So we are still required to file the map.

I'm 4 and 0 in small claims court.

I hate corps that go bankrupt, The owners keep their 6 figure salaries while not paying subs then the courts say this business has nothing so you get nothing.
I have heard of const company corp non payers having their Mercedes acid washed.

To PLS 7393, Apparantly I cant swing a sledge better. I threw out my back and can hardly sit after pounding 2" iron pipes in the ground.

Now if they only made a purse with a built in jackhammer . . . .
