I haven't seen any discussion of this in the CLSA or other forums as of yet. How many have seen or encountered the
"FINAL SACRAMENTO DISTRICT Nationwide Permit - Regional Conditions for California, excluding the Lake Tahoe Basin" This became effective March 19, 2012
See Item #4 on page 2 of 6, it is of the most concern. It would appear to be a "take of major proportions" in a case I am familiar with, a buffer of 500' is proposed, (2 x 250' from the edge of the waters).
Given the definition of "waters of the U.S." this would pretty much wipe out the potential for development in most portions of the Sacramento valley.
Has anyone run into this as of yet?
