This message is in response to your inquiry to the California Board for Professional Engineers, Land Surveyors, and Geologists regarding Senate Bill 1085. You questioned what was meant by “disciplinary investigation” if a licensee failed or refused to complete the assessment that would be required if SB 1085 is enacted. You also questioned what the possible outcomes of the disciplinary investigation could be and what would happen if the licensee failed or refused to comply with those outcomes.

“Disciplinary investigation” is a term that is synonymous with “complaint investigation” or “investigation.” If a licensee fails or refuses to complete the assessment after being notified at the time of renewal, the matter would be referred to the Board’s Enforcement Unit to conduct an investigation as to why the licensee had failed or refused to complete the assessment. Typically, such an investigation would involve contacting the licensee and requesting they provide an explanation for their action (or inaction) and providing them with another opportunity to comply with the laws. If the licensee continued to fail or refuse to complete the assessment, enforcement action could be pursued, such as the issuance of an administrative citation ordering them to comply with the law by completing the assessment. If a licensee fails to comply with a citation once it is final, formal disciplinary action can be pursued, which could result in the license being placed on probation with terms and conditions or being suspended or revoked, depending on any mitigating, extenuating, or aggravating factors."
