Yes, we pulled every building record, assessor records, plot plans, plat maps, etc. The survey has been completed and from my perspective, there are no doubts as to what to do and how to do it. The question has to do with a duty to file a survey.

Funny one. Again, I thank everyone for replying. I really appreciate everyone's comments. For what it is worth, I have a picture of the property in a recent article I wrote on Cooley for, in addition to the contract thing, the location of the buildings became important. I put one in the article in support of weighing a 100-year old building erected when the map recorded as valuable evidence.

On that note, I am heading to Missouri next month to lecture on Cooley. I like the way he thought.

I didn't intentionally lump you in with me - poor writing.

The point is 8762 has been discussed six ways to Sunday - same song different verse - and yet, here we are again. I have talked to groups of surveyors from Humboldt to San Diego and back again on the topic. On a weekly basis, I receive copies of surveys with two monuments, no monuments or a couple PK nails showing "boundaries" established. Many of them have these ridiculous notes evidencing the surveyor's failure to perform his duty.

I challenge anyone reading to provide me with a manual or guide which describes a "record boundary", which ignores selective or most field evidence, in connection with a field survey. What purpose does a record boundary serve? Clearly, it isn't in any written standards with which I am familiar. I believe it is simply surveyors refusing to survey or oftentimes, surveyors trying to save millionaires money at the risk of thier license.
