Client Indemnification

Post by Jim Frame »

An attorney pointed out to me that there are a couple of bills in the State Senate that would exempt design professionals (including licensed land surveyors) from contractual obligations to indemnify their clients against claims arising from anything other than the professional's own mistakes. If enacted, this would be a huge liability monkey off our backs. These indemnification clauses are already unenforceable when the client is a public agency, but these bills (which look to my uneducated eye to be two different approaches to the same thing) would extend that to all contracts.
