We need to stand up, as a profession and association. This was a great opportunity for CLSA to respond to an unwarranted attack. Instead, the association said nothing despite pleas to respond. The way we make progress is by making noise; not remaining silent.

I agree with you Mike, but I see a definite dumbing down in our industry. The title reports I see are little more than used toilet paper. Case in point; under section "And except any portion lying within public right of way". No easements or dedication docs attached where it is obvious that property had been taken for public right of way. Another doesn't show a 60ft wide concrete box culvert cutting the parcel in half. Lawyers reviewing ALTA's of tract lots or sectionalized land requesting a metes and bounds description then recording a new deed using the metes and bounds. Metes and bounds descriptions on deeds and TPs that are missing one or more legs.

In the Mississippi case, I would guess Visaline had more money to hire a better lawyer, maybe even contributed to the judges campaign fund.

Unfortunately, like title cos, Visaline probably has fine print that limits their liability to the fee paid for the report, so when an issue arrives it's the general public that takes it in the shorts. We should be able to limit our liability to the fee charged for the survey.

Yes, I agree. It seems as if the association has more important things to deal with; things like, who doesn't like who, condoning anonymous postings, and the slighting of egos.
