So I got a call to do a partial re-conveyance so a guy can take of of the lots shown on a map out of the loan.The map was done in 1961, The current deed lists both Lot 1 and Lot 2 in the description, not as Parcel 1 being Lot 1, and Parcel 2 being Lot 2. Seems like it's safe to do this. There is even two APN's.
Since this is a 1961 subdivision, even if the original owners bought both lots at the same time, and they were never conveyed separately, it believe he won't need a Certificate of Compliance in order for me to write up a deed for one of the lots. This is so his lender to take it out of the loan.
Does that sound right?

Lots of a subdivision (and parcels of a parcel map) remain so unless merged (actively), adjusted or resubdivided.

Understanding when lots from older subdivisions are, and are not, legally separate lots when held under common ownership for the duration is best achieved by reading the following cases. Start with the Abernathy case as it relies on the Gardner ad Witt Home Ranch cases.
