Howdy folks, I have a question to see if anyone has encountered this situation before. I have a client who abuts a major trolley project. The trolley contractor destroyed all the controlling and boundary monuments. Some were in the middle of the project and the others along the right of way. I have been asking for months about this issue and no one will accept responsibility. Pre-construction Corner Records were filed but nothing after the monuments were destroyed. The city that issued the permits is no help.
The trolley wants to charge me $750.00 to go into their right of way to survey, this after they destroyed everything.
Has anyone ever run into anything like this before? The cost of the survey is now somewhat astronomic.
