Newly published CA Appellate case

$4.185 million fine for building onto an easement. Plus court costs and attorney fees for trying to fight it. Ouch.

I wonder if the owners could have negotiated a swinging staircase for the occasional access - like a fire escape ladder.

Sounds like they had years and years to try negotiating many things to avoid such a decision, but were intent on ignoring the Coastal Commission, and then convinced (maybe by their attorneys?) to keep fighting. That's a hefty fine. And just because it's Malibu doesn't mean it's pocket change.
