RELOCATE AND SUPERSEDE EASEMENT-MAP QUESTION-

Post by papa surveyor »

Good evening
A SURVEY MAPPING QUESTION

Have you ever heard of a public easement being "relocated and superseded" on a parcel map.
The owner would offer a new location for the access easement on the map
The city engineer would accept the offer of relocating and accepting the new location and superseding the original easement location.

If this could be done, the map would not go to city council, because they don't want to go to City council for a "regular dedication of the new" and "VACATION OF THE OLD". The extra time and costs for waiting would be a lot...

I have never seen this done on a map. Have you?
your thoughts please.

The easement is for purposes of "maintenance and access to a drainage facility" (the drainage facility is by separate document
The old easement was granted per a map that is 40 some years old. no special conditions about the access easement.

thank you

The Subdivision Map Act section 66445 (j) speaks to the abandonment of easements listed - but not shown - on the map. The dedication of a relocated position would be done in the usual way.

yup, getting ready to record one, map has a statement regarding the easements to be vacated and that all the lots have access thru the new easements as shown.
