SB2 - $75 fee per parcel or per instrument

I guess this makes sense but did not anticipate that if one submits a single page ROS with more than one parcel being the subject, they would assess $75 per parcel. Does this fit everyone's understanding? I assumed it was $75 per map.

I have two in, one being multiple vacant lots owned by the same individual, and the other being three adjoining lots, two being owned by the same person, but regardless they want $75 per parcel.

(Oddly for the three adjoining lots I can highlight the two outside lots only, making it technically two parcels, with the same monuments shown, which is sort of a way to save $75)

Some Counties abide by the letter of the law and don't charge this crazy fee.

The former partisan AG's Opinion said he wasn't going to address the issue of the agency requesting recording. Which is exempt unless it is Joe Blow surveyor requesting recording instead of a governmental body like the County Surveyor. And Joe Blow surveyor will never be allowed to record if the County Surveyor signed the map. (Control should be by the County Surveyor to protect from alterations. Thus - exempt from SB-2 fees!)

I wish our lowly profession had some teeth and could take this to court. I pay with two checks. One, the legal ordinance recording fee. A second for $75 SB-2 rip off fee. (Which by the way . . . the County Recorder collects the money ($75) and most of those collected fees go to the State!! How many of these SB-2 affordable housing units which this fee was meant for, have you seen carried to fruition?!

I am sure it ends up in a slush fund so the government can meet its pension obligations. It is not a fee - it is simple theft.

What agency is charging per lot? I made sure this wasn't the case in San Mateo. I don't know of any Bay Area Counties that are charging this way.

Interesting - yes this in San Mateo County. I sent in the usual $84 extra per map and they balked on two of the six ROS maps that contain more than one parcel. Cut/paste of a portion of their reply: the "check that was provided is only sufficient for six 1-page map with only 1 APN per map"

So in their eyes it is clearly not a "per map" fee.

San Francisco County charges per parcel, or should I say, proposed parcel that is, on subdivision maps. Or per unit as the case may be.

Will have to check on ROS’s, but recall from LLA and COC’s that the general approach is: “round up”
