No maps with our new legal descriptions

Post by kwilson »

For many years I and I know most of you when creating legal descriptions include a map of same. However, I notice that the title companies love to remove the map from the legal description when recording deeds and such. I have included statements that make it clear that the map is included and is a part of the legal but no dice.

Has anyone else had that experience? I guess it's a good thing since we are the ones who interpret the legals and without a map its generally hieroglyphics to others. I know we all have had jobs with these mile long legal descriptions and no map and it takes a lot longer to figure out what the parcel looks like. It does give our junior surveyors something to do as they convert the legal to a CAD drawing. It just seems dumb when the map is right there and then they don't use it.

Ken,
If you find an error in a recorded deed, I have, and suggest you inform your client that the title company did not record the correct deed for them. They (Title Company) the client need to contact them and make them record a Correctory Deed.

Just like the usual lot line adjustment recordation, with no map (as required) by most agencies. If you find an error, get it right to make all easier in the future.
