Just curious to find if anyone has ever cited/used B&PC §8774 (c) or Civil Code §846.5 (c) to get an agency to reference monuments that are not accessible?
Thanks

Never been so formal
Haven't quoted the big fancy laws, but have called the county surveyor on occaison to have him reference a monument like that.
They have to work it in their schedule, but do get to it
fairly quickly. Especially useful when a section corner is purportedly in a freeway right-of-way.
Good Luck.
PS, I find it funny that we have two statutes which "allow" tresspassing . . .if you will, YET we have to get a permit to access state highways and freeways.
