ROS for the City Engineer

I have seen RS's that have signatures from City Engineers, but they also had County signatures too. I can't recall where or for what project.

Here is one, from 1986 in Pomona, LA County, CA, I saw recently on a project I am working on.

I don't think an RS can be reviewed by a City in lieu of the County's review.

8762 (e) says "Any record of survey filed with the county surveyor shall, after being examined by him or her, be filed with the county recorder."

An RS shall only be file after examination by the County Survey, according to that sub-section. 8766 also applies.

8764.5 also limits the statements to the "Surveyor's Statement", "County Surveyor's Statement" and "Recorder's Statement" and then it says "No other statements may appear on the face of the map except those required or authorized by this article."

My guess is maybe there was no expressed limit to the statements being shown on the map at an earlier point of time, but now it appears the "City Engineer's Certificate" shown on the RS I attached is not allowed by the PLS Act.

If the RS is required under 8762, then it must be submitted to the CS for review and filed with the county. It is not exempt either because the location is within the city or even if it is being done for the city.

If a public agency were performing the survey, they still must prepare a map that conforms with the requirements of an RS and file it with the CS's office.

Typically, a City Engineer has no statuatory authority to support that request.

That being said and in the interest of treating the City as any other client (assuming the City is your client), why not deliver a Draft copy of your RS, as submitted to the County, as a professional courtesy.

8765. A record of survey is not required of any survey:
(a) When it has been made by a public officer in his or her
official capacity and a reproducible copy thereof, showing all data required by Section 8764, except the recorder's statement, has been filed with the county surveyor of the county in which the land is located. Any map so filed shall be indexed and kept available for public inspection.

When doing RS's for Caltrans also, in dist. 7, we usually receive a review by the district surveyors at the same time it's being reviewed by the County. Both sets of comments are incorporated, but only the county survey signs their approval.

When I checked ROS's submitted to the County Surveyor (San Diego) 19 years ago, we, the County, would circulate a copy of the draft ROS to the City, if the PIQ was in a City, for comment as a courtesy.

Greg, at that time it was Clyde Elmore in the field section providing comments and not Development Services.

I would say it was rare to actually get comments back from a City Surveyor. As a County map checker, we would review the City's comments and proceed with the ROS review as appropriate and only the County Surveyor signed.

During my tenure at the City of Hayward, I was aware that the county was suppose to send any submittecd ROS (Draft) within the city limits to the city for their review and assistance to city notes and in-lui maps which the county might not have. In over nine years with the city, I saw zero draft maps come through the city.

As for cities being exempt, I believe that refers to the map review fees by the county. Currently the only record of survey maps I see exempt, are those being submitted by CALTRANS, and yes they are exempt from review fees.

I was doing C/L ties for a city as Corner records and the City engineer didnt want to send them to the County. Until I had the County Surveyor call him.
