A case in need of publication

Here is an interesting unpublished case out of San Diego. Attorney Tim Principe did a great job here. One of the other cases he and I were involved in has been cited. I think it is an important case. As such, it warrants publication.

I suppose that, because this was essentially a procedural ruling that reversed the trial court's summary judgment, there were no new issues at play for use as citation. It is instructional for its analysis, and gives the original plaintiff grounds to refile its cause of action - with a higher chance of proceeding to trial on the underlying issues.
