Can a City or County charge for a per airspace unit cost for review of a condo plan?
Per Section 66427(c)
Fees and lot design requirements shall be computed and imposed with respect to those map on the basis of parcels or lots of the surface of the land shown thereon as included in the project.
There is no provision in the state code for charging for review based on a per unit airspace basis, yet some agencies charge up to $100/unit to review something that they are legally not allowed to review.
I'm wondering if anyone else has run into this issue.
